Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of brokenelectronics.com and the services provided by Broken Electronics, LLC (“Broken Electronics,” “we,” “us,” or “our”). By using our website or requesting service, you agree to these Terms. If you do not agree, do not use our services.

2. Our services

We provide remote tech support, computer repair, data recovery intake, secure device wiping, device recycling, and Home Care Memberships for home users. Services are described on our website and are subject to availability.

3. Estimates & pricing

Prices and the estimate calculator on our website are provided for convenience and are approximate. Final pricing may vary after evaluation. Hardware repairs and data recovery services require review and your approval before final work begins. We will not exceed an approved amount without your authorization.

4. Your responsibility to back up data

You are responsible for maintaining a current backup of all data on any device you provide to us. You understand and agree that service may involve data loss if wiping, resetting, reinstalling, repairing, recovering, or recycling devices. To the fullest extent permitted by law, we are not responsible for the loss, corruption, or unrecoverability of data that occurs in the normal course of service. We recommend you back up your data before any service.

5. Data recovery

We cannot guarantee data recovery. Recovery begins with a paid evaluation. After the evaluation, we provide honest options and final pricing before performing any recovery work. Some data may be partially recoverable or unrecoverable, and an evaluation fee applies regardless of outcome.

6. Device wiping, recycling & destruction

Secure wiping, hard drive destruction, SSD destruction, and recycling permanently and irreversibly remove data. Once you authorize these services, the data and/or device cannot be restored. A Certificate of Data Destruction is available on request. You represent that you are the owner of, or are authorized to dispose of, any device you provide for wiping or recycling.

7. Remote support

Remote support is attended only and requires your approval to access your device. By requesting remote support, you authorize Broken Electronics, LLC to remotely access your device for troubleshooting and repair purposes. You may end any session at any time.

8. Home Care Membership

Home Care Memberships are billed annually and include the benefits listed on the Home Care page. The membership does not include proactive monitoring, managed IT services, unlimited support, patch management, EDR monitoring, or guaranteed response times. Memberships are for home users and are non-transferable.

9. Payment

Payment is due as agreed for the services performed. Payments are processed by our third-party payment processor; by paying, you also agree to that processor’s terms.

10. Devices left with us

Please retrieve your device promptly after we notify you that service is complete. A device not picked up within 60 days after completion or attempted contact may be treated as abandoned and disposed of or recycled in accordance with applicable Pennsylvania law.

11. Warranties & disclaimers

Except as expressly stated, services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to the services or these Terms will not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business interruption.

13. Business customers

Broken Electronics is designed for home users and small one-time support needs. If you need business IT support, managed security, Microsoft 365 management, or ongoing support, we may contact us and we can point you in the right direction.

14. Changes to these terms

We may update these Terms from time to time. The updated version will be posted here with a revised “Last updated” date, and your continued use constitutes acceptance.

15. Governing law & contact
